1. Introduction
Mobys Trade is a multi-vendor online marketplace that connects buyers with independent third-party vendors. Products sold on Mobys Trade are supplied directly by vendors, and each vendor is responsible for their own sales, including refunds and returns.
This policy is designed in line with the Federal Competition and Consumer Protection Act (FCCPA), Nigeria.
2. Vendor Responsibility for Refunds
All refunds and returns on Mobys Trade are managed and processed by the individual vendors.
Each vendor is solely responsible for:
- Reviewing refund and return requests
- Communicating with buyers regarding refund decisions
- Issuing approved refunds
- Handling issues related to damaged, defective, incorrect, or undelivered items
Mobys Trade does not directly issue refunds for vendor products, except where required by Nigerian law or marketplace enforcement actions.
3. Vendor Refund Policies & Legal Compliance
- Vendors must clearly display their refund and return policy on their store page or product listings.
- Vendor policies must comply with Nigerian consumer protection laws, including fair treatment of buyers.
- Vendors may define reasonable refund conditions such as:
- Return request timeframes
- Product condition requirements
- Exclusions for certain items (where legally allowed)
Refund policies that unfairly deny consumer rights are not permitted on Mobys Trade.
4. Buyer Rights (Nigeria)
In accordance with Nigerian consumer protection principles, buyers may be entitled to refunds or remedies if:
- Products are defective, damaged, or unsafe
- Items delivered are not as described
- Wrong items are supplied
- Orders are not delivered within a reasonable or agreed timeframe
Vendors are expected to resolve such issues promptly and fairly.
5. Refund & Return Process
- Buyer submits a refund or return request through the Mobys Trade platform or contacts the vendor directly.
- Vendor reviews the request and responds within a reasonable timeframe.
- If approved, the vendor processes the refund using the original payment method where possible.
- Refund completion time may vary depending on the vendor and payment provider.
6. Role of Mobys Trade
Mobys Trade:
- Provides the technology platform for transactions and communication
- May monitor refund disputes for policy compliance
- May intervene in cases of repeated vendor misconduct or legal violations
Mobys Trade is not responsible for individual vendor refund decisions or delays, except where required by law.
7. Dispute Escalation
If a buyer is unable to resolve a refund issue directly with a vendor, Mobys Trade may review the matter for compliance purposes. Continued violations by a vendor may result in account suspension or removal from the platform.
Buyers also retain the right to seek redress through appropriate Nigerian consumer protection channels.
8. Enforcement
Vendors who fail to comply with this policy or Nigerian consumer protection laws may face:
- Account restrictions
- Temporary suspension
- Permanent removal from Mobys Trade
